Using the Same Title as Another Book

Julie Broad explains that book titles aren't protected by copyright but may be trademarked. Generic titles like "How to Invest in Real Estate" are risky, while distinctive ones like "Freakonomics" stand out. Check trademarks first, then decide if a new title might serve you better.

So you found the perfect title for your book. You're all excited and you do a search on Amazon and you find out that somebody else has the same title already. Good news, you probably can use it for your title. But do you want to stick around? We'll talk about that in a second. Hey there. I'm Julie Broad with Book Launchers Dot com. Welcome to my office. So you found the perfect title for your book and you're all excited, and then you find out somebody else has already had this fantastic title. Well, the good news is you probably still can use it. Book titles aren't covered under copyright protection. In most cases, to qualify for copyright protection, a work must contain a significant amount of original expression. This means a lot of taglines, slogans and book titles are not covered under copyright, but they might be protected under trademark. What actually constitutes a significant amount of original expression? Not a short book title, not a general phrase like how to Invest in Real Estate or the Secrets of Losing Weight. Those are general phrases, they're not original expression. Something like Freakonomics. Now that's an original phrase and might be protected under trademark. So you got to check into that if you're coming up with something original. Let's face it, how to Invest in Real Estate isn't exactly a title that creates a bunch of curiosity. It's keyword rich, but it's probably going to have your ideal reader just flipping on by and not stopping. So you really want to have a title that captures attention anyways, so you want to have something way more original. I filmed another video on the five things you need to have a fantastic title. If it checks off all the boxes on that and somebody still used it, then you just got to ask yourself, why did their book not do well enough to be selling? And if it is selling really well, do you want to compete with that fantastic book that's already out there with the same title? Those are two really important questions that only you can answer. But if you really love your title, then you're going to have to ask yourself those tough questions and figure it out. Most likely, I think you should go back to the drawing board, brainstorm and find another title that checks all those boxes on that checklist of the five things to create a great title. If you like this video, give it a thumbs up. It makes my day. And of course, while you're here, subscribe to the channel so you catch all the tips so you can write, publish and sell a fantastic book. If you're in la, come visit me in my office. I'd love to say hello and we'll see you in the next video. Bye. It tells it has its keyword rich. Let's face it, how to invest in Real estate isn't a captured crap. Oh, now I'm stressed. I gotta finish this fast before the battery dies. Okay, that's a mouthful. Try saying that.
