A living will directs your medical care if you can't decide; a last will and testament distributes your assets after you die. They're both written instructions, but they handle completely different things.

A living will directs your medical care if you can't decide; a last will and testament distributes your assets after you die. They're both written instructions, but they handle completely different things.
Let's talk about the difference in a living will and a last will and testament. The reason I want to talk about this is a lot of clients come into me and they think they have a will, but they slide it across the table and then it turns out it is a living will. So I want to make sure you're aware of the differences in these documents. What a living will is, is it is a set of instructions for what happens at the end of your life. It's actually a healthcare document. It says what you want done when that time comes to make end-of-life decisions for you. It's like a, like a set of instructions on how you want your care to be administered, and you're naming someone that you authorize to make those decisions. So this is when you are unable to make them yourself. And what a last will and testament is, is it's actually a document that says where you want your stuff to go, so your assets to go when you pass away. And who you want to be in charge of getting there. It's like, like a set of instructions that you give to the probate court to administer your estate. So they're both sets of instructions, but one is for your healthcare, one is for your assets.
