Mark Kohler explains HSA eligibility rules: your spouse needs to be on a high-deductible health plan to open an HSA, even if you have good coverage through your job. Options include having your spouse opt out and buy an HDHP through healthcare.gov, or using a 1099 business structure to deduct health insurance and qualify for an HSA.

I don't have a high deductible plan for my work, but I do have a pretty good insurance plan. Can I still get an HSA maybe for my wife and kids even though they're also covered on my plan?
The answer is no the way you phrased it. But let's say you and the kids have some medical things so you keep your insurance for you and the kids. Let your wife opt out so she can go get her own plan. Price it out on healthcare.gov she might be totally healthy. She doesn't go to the doctor for anything. You're done having kids so she goes and gets a high deductible plan. She can open up an HSA and get a qualifying plan. If you have a 1099 in the family, you've got a little small business going on. You can write off her health insurance 100% and go get an HSA so she could get one and then you just stay on the family plan.
