In this YouTube video, Naples real‑estate specialist Renee Han explains the nationwide regulatory changes that take effect after August 2024 regarding buyer‑agent commissions. She outlines the new legal requirement that buyers sign a written agreement with their agent before any showings—virtual or in‑person—detailing the commission rate and the specific services the agent will provide. Han then enumerates the full suite of services a buyer’s agent typically offers, including market education, property selection, showing coordination, market and pricing analysis, negotiation, contract and deal structuring, closing oversight, and post‑purchase vendor referrals. She clarifies how the commission is negotiated based on the scope of services, emphasizing that any portion of the commission not covered by the seller (who can no longer advertise willingness to pay it in MLS listings) becomes the buyer’s responsibility. The video concludes with a call to action for prospective buyers to assess their needs, discuss a fair commission arrangement, and move forward with confidence in the home‑buying process.

Hello, this is Renee Han, your Naples real estate expert. There have been some changes in the real estate world that might affect you if you're thinking about purchasing a home. This is not specific to Naples, this is national, so let's break down what it means for you. The biggest change is how buyer's agent commission is set. Agents are now required to have signed agreements with buyers in advance of showing property, whether it's virtually or in person. That agreement must include the details of agreed-upon commission rate to be paid paid and the services to be provided. Gone are the days when the seller dictated the commission. We will work together to decide on a fair commission rate that fits your specific needs. In my business, the commission rate will reflect the extent and type of services that you are looking for. The buyer's agent role is much more than just unlocking doors and showing you houses. As a buyer's agent, I can serve as your partner in the home buying process providing invaluable services. One piece, before showings are even scheduled, is an educational role. This is often taken for granted but can take considerable time and expertise to provide information and insights about the area, the buying process, the closing process, cost considerations, and many more things. These services are often provided at the start of the working relationship and are critical to helping guide and shape what and where you as the buyer may decide to purchase down the road. Helping to down-select properties is another area, creating and orchestrating showing schedules to coordinate availability between all of the involved parties, and then providing access needed for showings. As a part of this process, I also provide valuable information about the home, the community, and the area to help you as the buyer with your decision. Another value-added service is market and pricing analysis. This is to hope— help you on both the search side and the offer side to guide you towards properties that fit your financial needs, and then to actively represent you as the client in the negotiation process to ensure that you not only get the best possible deal on the home of your choice, but you also have the information necessary to gauge the implications of that purchase at that price. I can also provide expertise on structuring deals as well as competing and managing contracts This helps ensure that your interests are protected and that the contractual obligations are understood, accounted for, and managed appropriately. The closing process— coordinating that and providing oversight is critical to helping ensure a smooth closing. I can play a quarterback role, if you will, in this process, using my expertise to oversee all the required activities, tasks, and requirements involved in closing on the purchase process. This will include, include things like inspections, surveys, appraisals, and many more important pieces. Another aspect is providing consult and guidance to help get connected with the right resources before, during, and after your home purchase, whether it's with lenders, insurance providers, inspectors, renovation resources, furniture options, just to name a few. Although the new regulations no longer allow sellers to advertise their willingness to pay for buyer's agent commission through the MLS system or any other downstream or connected system, some sellers may still be willing to pay for all or a portion of the buyer's agent commission rate. This would be determined as part of the offer negotiation process. Any amount agreed to be paid in the buyer— upfront buyer and buyer agent agreement that is not covered by the sellers will be the responsibility of the buyer. So please keep this in mind. Also keep in mind that this is a requirement of all Realtors. So after doing a thorough review of what your needs are, we can discuss and agree upon the most fitting service and commission arrangement to get started on supporting your purchase. I look forward to serving you and working together.
