The FMCSA is expanding its Crash Preventability Determination Program to include four new crash categories, expected to roughly double eligible submissions. Starting in early 2025, trucking companies can challenge side-strikes, parking lot collisions, loss-of-control crashes, and any incident with clear video evidence to improve their safety scores.

The FMCSA just announced that it is moving forward with the proposed expansion of their Crash Preventability determination program. In April 2023, the FMCSA proposed adding four new crash types to their CPDP eligible crash list. The four new crash types in the proposal 1. A commercial motor vehicle was struck on the side by a motorist operating in the same direction. 2. A commercial motor vehicle was struck because another motorist was entering the roadway from a private driveway parking lot. 3. A commercial motor vehicle was struck because another motorist lost vehicle control. 4. Any other type of crash involving a commercial motor vehicle where a video demonstrates the sequence of events of the crash. Adding these four new crash types is expected to double the number of eligible submissions received by the agency each year. With these changes, trucking companies can improve their Crash CSA Basic score since many crashes involving large trucks aren't the truck driver's fault. No firm implementation date has been set, but we expect that it will likely happen in the first quarter of 2025. Unfortunately, only crashes that happen after the implementation date of the new changes will be eligible for consideration under the expanded program. Thanks for watching and stay safe out there.
