Robert Ta and Speaker A uncover a clause in Anthropic's Fable data policy that keeps flagged content for up to two years, conflicting with customers' zero-retention agreements. Anthropic stores user data 30 to 60 days for security, creating IP-leakage risks. No government agency currently mandates data-retention periods for LLM providers.
I think that feature that Anthropic put into Fable, which was storing data for security purposes for 60 days or 30 days or 60 days, was a big flag.
Especially if you fucking sign a deal with them and you said zero data retention and then boom, hey, we're retaining your data for 30 days, 60 days. And if I recall in there, if they flagged it as inappropriate content, they could retain it for 2 years. That was what they rolled out with. So yeah, any CEO where you're using this technology and you're trying to accelerate your IP development And now this is like develop IP. Oh wait, there's a stream of IP. Maybe we're potentially at risk slash losing.
And I think to Anthropic's credit, they're trying to do this proactively and saying there should be a government regulation that we have to maintain this data. So we're going to do it anyway. This is why they're asking for regulation because they know they should sort of be doing this stuff, but there's actually not a government agency that says retain your data for this period. It's not a compliance thing yet. That beckons a question of like, what should the relationship of a customer to an LLM and the government be? And that's where we can look at the different possibilities of how should the government regulate it? And what's the relationship between me as a consumer and the government? Not even what's the relationship between the government and Anthropic?
