He was not. All right, here we go.

The insurance agent who pleaded guilty to scamming senior citizens here locally out of nearly $1.5 million just learned he will spend the next nine years behind bars downtown. As he learned his sentence, several victims.

Spoke in court today about the trust that they had for him. They say that they considered him a friend after knowing him for so many years, someone they thought would take care of their money.

And I'm a strong person, and I can go make more money, but the impact goes far beyond the dollar. The impact goes to humanity. It goes to trust. It goes to why. I don't understand this. This man had so much.

Why?

I trusted Sean. I really did trust him. He was a good friend.

I. I thought.

At his sentencing, Sean Heffernan sat quietly next to the public defender as victim after victim took the stand and shared their stories. It was a licensed California insurance agent that many elderly San Diegans trusted with their money after attending his seminars. But more than a dozen people were scammed out of their savings. The prosecutor says Heffernan took more than a million dollars from victims, promising investment returns, but instead spending it on himself, buying jewelry, rental properties, and even a Maserati. Part of his scheme, known as churning, included convincing victims to cash out their annuities. A team of Secret Service agents, attorneys from the DA's office, and investigators from the Department of Insurance made the bust. Heffernan recently pleaded guilty to 29 felony counts, including elder fraud and grand theft. Heffernan chose not to speak in court today. He will spend the next nine years in state prison and have to pay restitution to his victims. Reporting Downtown, Mimi Alcala, 10News.

Just like right there, scamming senior citizens and pled guilty.

This is no alleged. This is no alleged.

This happened. This happened.

Out of nearly $1.5 million. Just learned he will spend the next nine years behind bars. Ten years. Reporter Mimi Alcala was at the courthouse downtown.

Okay, nine years, Javon. Like, this is serious. Nine years of his life will now be spent in prison.

As he learned his sentence, several victims.

Spoke in court today about the trust that they had for him. They say that they considered him a friend after knowing him for so many years, Someone they thought would take care of their money.

And I'm a strong person, and I can go make more money, but the impact goes far beyond the dollar. The impact goes to humanity. It goes to.

Right, right. Like, I. I'm not making any. I can't. Fancy.

Like, this is.

This is, like, in order to. In order to scam someone. Like, in our industry, you know, you start off with different types of life insurance. Like, she said, he had everything right. And I'm just literally sitting here looking at the caliber of lawyer, his public defender. That mean he really ran through all of this money. He didn't even have money for a lawyer. It said his public defender. First thing I saw is buddy right there. He looks like he's. This guy. Looks like he looks like you going to jail. If I walk out and my public defender looks like him. I didn't see the. I guess he don't got nothing to say. He was like. He's like, this is who you sent for me? Like this right here. He didn't even have 10, 15 grand left of 1.5 million to be able to get a lawyer to try to even negotiate. Oh, my gosh. Like, and look at. He can't even look at these folks. That's like, they lost their trust.

Well, I mean, this. I feel like there's nothing we can say here, Javon. Like, she literally just said it all.

She said it all. Like, you can make more money. He had everything. And guess what? People do business with people they trust. And this is where agent verified Comes in at. Because guess what? They could have read the reviews or lack thereof. Right? But it's scary because they trusted him already. Right? He was in their face. This was pre Covid. This is. You know, they seen him. They met him for years. He was a. You know. That's sad. It is so, so sad. Wow. It.

Yeah. But I mean, this is why we have this podcast again, because it's like, learn from. Learn from people that have gotten scammed. Learn from. I mean, and this is. This is heartbreaking, you know, but look at her. She's saying, hey, I'm strong. I'll go and make whatever I need to. But why? I mean, like, good for her for standing up and making. Taking. Like, taking this guy down.

I mean. I mean, here's the thing. There's low, but then they're scamming seniors low. Like, it's low, but then there is a low, low, low, low, low.

It gets lower. You can always go, look, Why.

I don't understand this. This man had so much.

Why?

I mean, this makes me think of my grandfather.

Yeah. A good friend. I thought. Now this second guess in your decision.

Part of his scheme, known as churning, included convincing victims to cash out their annuities. A team of Secret Service agents, attorneys.

From the VA that's at least one tip we can share, is don't let any agent tell you to cash out an annuity. Like, there's never a time for that.

Yeah, Like, I think.

I mean, we.

We can. We. I think we. I mean, we try not. I'm not going to give broad stuff, but there's never a time that someone just said, yeah, you should cash that out and give it to me. Like, just agree. That's a no.

His office and investigators from the Department of Insurance made the bust. Heffernan recently pleaded guilty to 29 felony counts, including elder fraud and grand theft. Heffernan chose not to speak in court today. He will spend the next nine years.

Yeah, but silence is almost arrogance. You can say, I'm sorry.

Like, when I heard Maserati, I mean, I was done, but then I heard Maserati, and I was like, are you serious? Like, are you. No, just.

No. All the years of trust just gone away off of a couple people. Now you're going away for nine years. Nine years.

And then after that, you've got that on your record.

And, you know, the best part is when, you know, we. We've got some pretty good leads, if I do say so myself. Just maybe a little bit. Just a little bit. And so our agents are getting the leads. And what's a lead if you are like, what's elite? So a lead is someone that has heard about life insurance and they've requested information. So we're not, like, you know, cold Calling through the phone book and bothering people out, you know, out of the blue, it's like, hey, someone said, hey, I'm interested in this. And then our agents respond to that, right? So our agents meet with people that have asked for help and, you know, see, hey, what is it that you need? And so talk to one. One of my agents, talk to a family this week, and they said, hey, I've got coverage at work, so I think I'm good. All right. So I even said, okay, hey, congrats on the coverage at work. First of all. That's a great benefit, right? And, you know, kudos to you for taking advantage of that. But kind of started digging into what happens if you don't have that job anymore. You know, downsizing happens, or what if you decide to move to another position? You know, does that work policy go with you? They kind of were like, I don't know. So they actually. She actually went, which I thought was really cool. And at, like, the policy and like, the HR benefits and stuff, because the she, you know, that. That the. The guy was, you know, very inquisitive and really wanted to know. And so he was like, oh, wow, this won't go with me if I. If I don't have this job anymore. So the client determined that for himself, which kind of, you know, made that stronger. It wasn't just our agents trying to sell. Say something to him, right. Kind of uncovering what is the client wanting. So realize, hey, they've got coverage at work. And they. Then they realize, hey, that's not enough. So as we were. As she was talking through, like, the client's sure, he's concerned if something happens to him, wants to make sure that, you know, the wife is, you know, doesn't, you know, can take some time off work, take care of the kids, make sure that they can stay in the home. Kids don't have to move all that stuff. And then the said, but, you know, I saw something in the video, and what made me respond to the ad was it talked about, what if I get a heart attack? Or what if I get a stroke? He said, my dad had a heart attack and he was off work for a year. Like, what if that. What if that happens to me? And he said, that's really why I responded to this ad. And so. So they kind of started talking about. And you realize, like, when this guy was younger and his. I think he was like a teenager, the agent was telling me when the dad had a heart attack and was off work. And he said, I mean, the heart attack was terrible. We were so worried about my dad. But the next year was just awful because dad couldn't work. So mom's doing, like, double shifts and now, like, all the kids activities, like, everything that they had done, they had to, like, stop because there wasn't enough money coming in. And he just. And then, not even that year, even when dad went back to work, there were still, like, ongoing health issues. You know, it just. It was such a shift in their family. And he was like, I didn't even know that. That there was something that I could do to prevent this. He said, my biggest fear is that I have a heart attack and my wife and kids go through what I went through as a child punch, you know, and so then that agent is sitting there going, I have a solution for you. You know, and so, I mean, like, it was just so amazing to hear the story from the other. And we were actually in our. In our live zoom room, and they were. They were doing that. So we were all getting to hear this and be like, wow, like, you're making such a difference for this family. And so they got some protection put on, so we're able to get, you know, some life insurance put in place where, hey, no matter what job this guy has, this policy is going to go with him. They got the wife covered as well and made sure to include what we call those living benefits. So that's where, okay, he's got a heart attack, he has a stroke, he gets cancer, he gets kidney. Like, no matter what happens, his family's lifestyle is not going to change. And you could just hear it in his voice. Like, he was so. He was so relieved. Like, he was so relieved, and the wife was so relieved. And then it was like he didn't even think, oh, my gosh, what happened if this happened to my wife? And so, like, just them realizing they can take care of each other. We threw in some kids policies as well. You know, taking care of the children, so locking in that for life. I know we talked about that last episode, and so it was like, it's just amazing to see, like, it's not just the death benefit that we can help with, you know, if the. If the worst happens. But it's. It's also interesting to see some people don't even see death as the worst. I mean, obviously that's awful, like, what he. Because he just remembered so vividly, my life changed. I was worried, is my dad gonna live? But now my whole family, like, the stress, the total change of lifestyle, he was like, it's not that. Oh, I didn't get to play soccer anymore. It was like I never saw my mom. My parents were stressed. They were worried. They were fighting. Like, it was not a great. It's like we had this great childhood, and then everything stopped because of this event. And he was like, I don't want that for my family. And then it was like my agent was able to say, all right, I got you. This is not gonna happen for your family because you made this choice to get living benefits. And I mean, like, how powerful is that, Javon? I mean, that is.

Let's go in with the bald head and blue jumper. It's his first appearance on 23 charges. He's not going to like what he hears.

Not sure they're high enough. On the first count. I'm increasing the bond to $50,000. These are very serious allegations, El Swaty.

Charges range from misappropriation of insurance funds, fraudulent use of personal ID info, to organized scheme to defraud. His court appointed lawyer pushed back on the bond increase.

Well, the legal argument is that I don't believe the court has jurisdiction to touch the monetary bond set by the duty judge who has already determined PC and the applicable bond amount.

In this summary report, it states Al Swedy is a licensed insurance agent in Palm Beach County. It goes on to say, el Suede wrote 11 policies for seven people. Stick with me on this one. The report says he accepted and deposited over $122,000 worth of premiums paid upfront and in full for each of those policies. Now here's where the report says he went foul of the law. Elswaiti got into finance agreements with two premium finance companies. They finance life insurance. He allegedly did this without the approval of his clients. Also included in the report he wrote his clients names on the paperwork but put his personal or work address and phone numbers so his customers were never notified of late payments or cancellations of policies. But that's not all. The report says El Swati's alleged dirty dealings cost Arthur Reyes over a million dollars in out of pocket expenses. Fences to repair his apartment building when Hurricane Ian destroyed it in September 2022. We don't see the judge but we hear him loud and clear.

As far as my review here at first appearance and the nature and extent of the alleged criminal activity and the scheme that was apparently involving this man, I think 50000 is fair.

Elsweytti tried to speak, but instead is getting ushered out of the courtroom. But his attorney did let him know what it was going to cost to.

Get out your bond is probably should do this math. Probably close to $100,000.

I spoke to a representative of the Bureau of Insurance Fraud and he told me by phone that he truly believes there's a possibility of more victims out there in Palm beach county. Todd Wilson, WPTV News Channel 5.

My electricity bill dropped from $150 to $52. Doing this one thing when I spent $49. What?

Wow.

That's else.

Wow. Good for that judge. Good for that.

That judge was like let me tell you how this is going to go, friend. That judge was not having any of it.

So this is like a mixture of property casualty, you know and, and life. Because they're paying their premiums up front and instead of sending it, you know, to the insurance carrier, he put in premium financing which I'm not too familiar with.

Premium. Well, I've done that some with some of my larger policies like more advanced market type policies where and sometimes businesses do it too. Jamon. So it's like where you're. Because it's like much larger premiums. All right. And they're covering like not just a person but it could be like for a key man policy or for a larger business. And so they're, they're funding the life insurance policy and the policy amounts are usually like, you know, in the millions. So it's not just for, you know, your $50,000, $100,000 policies. So you're, you're, you're funding this. It's protecting the business. It's protecting key people inside the business. And so they're partnering with banks to be able to fund the policy. And so it's just another way for, for companies to kind of leverage different funding options. So that also tells me like he's, he was working with some very high profile clients here. Like it's not, oh, I'm, I'm just working, you know, with, I'm going into someone's home and setting up premium financing. Like he was trying to do some pretty shady stuff at a pretty high level. And obviously he did not get away with it. No, he, he did not get away with it. Okay. And I gotta say, I did notice one thing here. It was another pointed lawyer. Lawyer. I did notice that lady walking in.

You know what I found interesting there is like his court, his lawyer pushed back. But what did he push back on the amount of bond? Like he couldn't push back on any of the charges. Like so we'll, we'll try and get like around it here, you know, is.

It's so premeditated. And I mean that was one organized. What it was organized scheme of fraud or I don't remember the exact wording, but it's like it was so calculated. Like that's what's so scary. Oh man, that's just, that's just wrong on so many levels. And then after getting over a million dollars, now he's at a court appointed lawyer. Like that's where he is. Like it does not pay to do the wrong thing. But I have to just, I have to say it again. Hopefully. One thing if you've taken away from our podcast is if you ever have a life insurance agent that's asking you to pay them directly, don't ever do that.

Property casualty. So you know all these companies, they have to no if, ands or buts, accept their own portal, their own receipt, their own monies. You know, they're paying these up upfront premiums and they thinking like I'm protected for the year and then the guy ends up with a million dollars out of pocket. I'm sure El Sweeney was not prepared for hurricane.

The hurricane came to get him.

Do you imagine thinking that you had life insurance? I mean, I could think you had insurance on your property because you paid your, your agent up front. And a hurricane comes, you're like, this is horrible. But I know I'm insured. Only to find out that's. Yeah, lock him up. Allegedly. This is all allegedly with direct commentary from wow.

Clear.

They don't play.

They don't play like, you know, so if you. If you feel like something is off, there's. You can go report it. Like, you don't have to just wonder, am I okay? Like, you can make sure that. First of all, make sure your agent is verified. So that's the very first thing. Go to agent verified. Use agents that are on agent verified. You know, that's going to be step one.

Read their reviews. You know, check their reviews.

So it was like, after my license updated. And so, like, the next week, I was talking to a client, and I had not updated the license date. So it's so. I mean, it was just my fault, right? I didn't go up and update it on agent verified. So the lay actually said to me, she said, betsy, your license said that it expired last week.

Yes, yes.

And I was like, oh, my goodness, ma', am, I did not update that. That is totally my fault. Let me send you over my updated license. I did complete all of my, you know, professional development, so my license is current. I can show you. I said, but also, you know, my bad for not updating that. So, you know, thankfully, I had been up front and we were, you know, she kind of. I was like, hey, I'm blind. I just. I just forgot. So she kind of laughed it off. But I mean, like, she read that, like, she checked my agent verified page. And I was so glad. I was like, this is why we're doing it. You know, Like, I love that. Like, call me out. I'm good. If I can't. If I can't hold, if I can't stand up, then, no, I don't deserve your business.

But then they pass it and think that it's like, oh, it's the end of it. We're just getting started, you know, we're just getting started.

This is now you have arrived at the starting line.

Yeah, you're now. That was the. That was the pre. Pre race, but, man, she is just coming out. And I love the first month of just making mistakes. Like, I'm testing to see the grit of my team because, yeah, we. We roll out the leads, we roll out the CRM. We roll out everything. But now it's time to see what kind of resist. Like, what. How. How are you? Like, this is. I did everything I said I would do to get you to the race. How are you? And she just comes out crushing, like, making a mess. And it's like all the. And it. And I'll be honest, like, she. She's the only woman so far that's coming out crushing it. And it's so funny watching the fellas, like, they're scared. Yeah, they're scared over there. And she's over there, like, taking names, like, crushing it and taking names, and they're like. And all these grown men are like, I want to be like her. I want to be like her.

I love it.

I want to be like her, you know, but super focused on, you know, obviously, the trainings that we provide just listening to her. And now I'm. We're friends on social media now, and I'm seeing her in the different social media groups and, like, really taking ownership. And it was the big flex, but I, you know, so.

Okay, okay. What's the flex? What's the flex?

Her big flex. I was like. So I was looking on the commission sheet, and I didn't see her name, and maybe I didn't see her name because of her upline. And I was like, have you gotten paid yet? And she was like, I've got paid, like, five times this week already.

Okay.

I was like, excuse me. Let me go mine. Let me go mind the business that pays me, okay? And I was like. And Just listening. Having her from start, we're very fearful not knowing, you know, who I am, what we have, you know, the trust there. And a lot of folks come in like, this is too good to be true. And I'm like, it's not. You just gotta add you're working. And to hear her say, like, I got paid five times already got paid five, five times.

You need a lot. That's like a social media thing. I mean, I remember I was a teacher. I got paid one time a month.

Ouch.

One time, one time. I mean, she's getting paid five times a week. I mean, Javon, how many, like, how many deposits do we get in a day?

Yeah, right. You know, the, the beauty of the, of the, like, things that we take for granted, right?

So totally take for granted. I mean, and now she is living, she's living that. So, man, guys, if you're like, I would like to get five deposits in a week. Yeah, hit us up.

Mason family is accused of a three million dollar scheme that a prosecutor says was the work of insurance fraud.

And this revolved around a sick relative.

Well, those who live in the Mason Deerfield Township area know that Long Cove is both the boardwalk and Park Place neighborhood of this area.
