Prove It: Why 3rd Party Validation Is Critical For Your Business ft. Donese Worden

Joe Polish and Dr. Denise Worden discuss why businesses need third-party validation for their claims. Unsubstantiated marketing can trigger FDA and FTC fines, and companies in health and wellness face particular risk if they can't back up what they say with objective data.

Thank you, Joe. And I want a special shout out to Joel Weldon for saving me from giving you a slideshow with a whole marathon with 24 slides. And he said, that's a workshop, it's needed. But this is a 10 minute talk. So Joe, I say the challenge is, do you have more than 24 toilets pictures? Right? So as a researcher and a physician and a global educator and product developer, I know the real importance of proving your claims. And I was in this very room, in that back corner not too long ago, brainstorming my new research company and I'm sitting there with a person who owned a wellness center, sitting with a realtor. We had all kinds of different industries and I asked them, I said, what are you saying? What are the claims you're making, making on your sites? What are you saying out there? And when they came back and they gave me an excited bravo, this is what I do. I'm the best at this. I asked the ultimate question, a fundamental question. How are you going to prove that claim? Yesterday we talked about several things, right? When you have a great. Joe said, when you have a great marketing idea, it's essential to test it. Dean talked about the after and using metrics to look at the research or your referrals. How are you measuring your companies and your claims? Recently there is increasing governmental scrutiny from all of our businesses for all the claims and the services that we're trying to work with. Who are these watchdogs? FDA and ftc. Both agencies are very active right now. Currently the range of fines is going from $100,000 to $10,000,000. Remember our discussion yesterday with Brian is about well if you think but my business it may not apply to well you better think again. The harsh reality is that if you are saying or marketing or selling anything online, the FTC is watching you and you better be ready to be able to defend your claims. Their job is to monitor advertising misleading claims and even that gray area and using testimonials is no longer applicable. You can't just do that unless you have a third party verification for that. So let me review some of the businesses right now that have had fines and see if your company fits into any one of these. The Starkwood tech companies fitbit $500,000 fine. Right. And the beloved Oura Ring lumosity settled for $2 million. And a new bill has actually been introduced to require AI companies to have a third party validation for what they've got going on. Digital marketing firms have been fined. Email marketing companies. Alex becker was fined $500,000 for marketing everything. Well I would claims of what he was doing in his courses and his software influencer marketing, right. 1.2 million dollar fine to the Kardashians for failure to disclose their acknowledgement that they got paid for the endorsement of a product. Life coaches. How many of those business coaches in fact it's Tai Lopez got fined by the FTC over a million dollars for misleading claims from the effectiveness and the outcomes of his online business courses. Tony Robbins even has been fined. Russell Bronson just was fined $1.2 million. Dean Grazioso $500,000 for exaggerated claims for his the returns for the sales and the marketing programs that he has. Business coaches talked about Tony Robbins, he got about a half a million dollars and it was about the efficacy of his seminars, what he was doing in his coaching programs. If your enterprise happens to be in the health and wellness industry, the stakes just went up. Far more eyes on you. For example, if you are saying that you have a supplement we used to get away with saying okay, the ingredients in this supplement have been researched. No longer applicable. You have to have research on the entire ingredient. Palm pomegranate juice rate $8 million a lash company. I think the last one was $43 million. The FDA has even created a new office. It's for food safety, for dietary supplements and for just innovation. So they are starting to enforce these and they're not just giving you a warning, they're coming after us. This underscores the increasing reason why you really need to do some things for your businesses and start looking now. I agree. We've got to clean up the health and wellness industries. We've got some bad players. Certainly there's another side to this. But the other side for the good players, you can't just rely on the testimonials and you got to be ready to back up your claims. Currently there's a small company that based all of their educational programs and their products on one little ingredient. They never thought that the FDA would be having scrutiny on that one little product. Well, they did. So now they're spending more money for a last minute safety and efficacy study. We're going to have to start doing it. And it's not only regulatory agencies. Do you realize that Amazon as of April requires third party validation for anything for the supplements and the products that they're selling on their site? So how are we doing in Genius Network? How are we doing?
Hey, I hope you're enjoying this video and I want to let you know that I have a new book that's come out and if you'd like to get it absolutely free, there's a link below in the description. Well, I just mentioned some big names getting fined and I'm just happy to report that Joe Polish and Alex Mendocian and Michael Bernoff have any. They're in the clear. I know because I researched it. I researched it. You stole my line. I was gonna say it. Good job John. Alright. However, here are a few examples of claims that I just looked at on our Genius Network from your guys profiles. And I don't know if you're using it outside of this, but there are some problematic ones and I just want to bring to your attention a few examples. Proven system to grow your business from 3 times to 10 times. Get rid of stress. Proven sales system that boosts your conversion by 50% in 30 days. Now you may be collecting data, but if you're doing it in house and it's not a third party stamp, you're still not protected. Scale your business at unprecedented rates. Faster growth, more money, Sustainable way to stay sober at parties. Restores cellular energy, and the most transformational personal and professional live weekend in the world. In fact, there were several world's best in this group and also America's number one. How are you going to substantiate those claims? Think about your business right now. What are you saying out there? What are the claims? Do you really understand it? And when's the last time you've conducted an internal audit on your company? When was the last time that you reviewed your website and your marketing materials? You've looked into how you're collecting your data and have you identified the regulatory agencies that you're really being looked at by? And do you understand the FTC and FDA and how that might apply to you? When's the last time you've looked at that? And I just want you to know that I think we also have to think of our business missions. When's the last time you reviewed that? Have you gotten away from what your original mission was? We talk about imposter syndrome in this group. What about imposter business syndrome? Right? And start thinking about how far away have we gotten away from that? Now, beyond this little quick audit, if you want to avoid penalties, fines and possible shutdowns, you need to start thinking about a few things. You must take action now, don't wait, it costs more later. And consider being proactive. One easy way to do it, we always look like, who can I hire? What can I do? A CRO is a contract research organization. They can implement proactive steps that you could be doing right now and starting to start your compliance process. Those FTC and FDA are not just issuing warnings. They want to know if they knock on your door, that you at least understand what you should be doing and that you're taking steps to get there. That's the difference between a slap on the wrist and a major business shutdown. Many of you are already collecting your data. Testimonials, customer reviews. You're collecting it and that's great. But remember, the problem is it's not objective. You're doing it in house. FTC is going to say who has analyzed your data in a manner that's not tainted. So you know these in house processes that we have, they start the way, but they're not going to suffice for the ftc. And even consumers have caught on in saying, don't trust those stars anymore. They can be manipulated. A lot of us, if you start thinking about a CRO, what I want you to know is that the large CROs cost a lot of money and they have a cookie cutter. They may take a supplement or a product and throw it into a pharmaceutical model when it's a nutraceutical and that money's not needed. They also can't be as quick, can't be as fast and budget adaptable to what you need. You're looking for a company that will work with you, that will grow with you, Start with what you've got right now, teach you how to collect it objectively and be able to grow with you. And when it comes to conducting research that I will tell you that I've seen products be at a million dollars and the same exact study be done by a small CRO for $60,000. We need to start thinking about research is marketing and putting it into our budgets. We can't put it off and say I'll do it later. Time is here and now. When the FDA and FTC knock on your door, want us to be ready. Here's the silver lining. R and D credits. Yay. You can get up to 20 to 30% back in R and D credits for qualified research. Great. It's toward wages and overhead. My claim, every business in here needs unbiased third party validation for your brand differentiation and for your regulatory restrictions. Or I will say regulatory resilience. Right. Today you're informed, you're equipped, you know kind of what to do. I've informed you we need to be aware and be ready. Now go out and prove it.
