A realtor can't be blamed for missing a clogged sewer line or broken heater in summer because neither would show up during a typical showing. You'd need to actually test the sewer system, and nobody turns on heat in July in North Carolina.

Good can mean a lot. They didn't say perfect. Perfect would have been a problem. So when I talk about not using absolutes, don't use absolutes. But let's also have a very difficult conversation about clogged sewer lines. How would you know the sewer lines were clogged if the house was vacant? You'd have to test the system yourself. And as realtors, we tend to advise our people not to use the facilities in someone else's home, don't we? That's one of our showing practices. Please hold it till we get to the gas station. It's entirely possible that the realtor had not used the commode and the tenant didn't either. Now, how about the heater? What if this was in July? Do most tenants cut the heat on in July to see if it's working? Course not, especially not in North Carolina. You're just praying to get out of the heat. So if it's in the summer, the realtor may not have known. So that's why the realtor did not get in trouble here, did not use absolutes, and it wasn't things that would be readily known.
