Register Trademark Before Having an LLC?

Lot of my clients ask me what they should register first, an LLC or a trademark. As I'm sure you know, the primary purpose of an LLC or corporation is to provide you with personal liability protections and separate you from your business. Whereas with a trademark, you are going to be protecting your business's name, logo, or slogan from other people who are trying to use it and sell a same or similar product or service. In most situations, you're going to want to register the LLC first, and there are two main reasons for this. First, because registering an LLC only takes about a week, whereas a trademark can take up to a year, and you're not going to want to be operating your business without an LLC for that entire year while you wait for your trademark to be registered. The second major reason is because when you're registering a trademark, you're going to want to list an owner, and in most situations, you're going to want the LLC to be the owner. So you'll have to have the LLC registered first. And the reason you're going to want the LLC to be the owner of the trademark is because it's going to increase the value of the— LLC and the business, and because it's going to make it more appealing to investors who want to invest in your business, or if someone wants to buy your business, they're definitely going to want to make sure that the LLC is the owner of the trademark.
