If you're married and you're the first to die, it's very likely that your husband will be remarried or in a serious relationship within 2 years. A clinical psychiatry study showed that to be true for 61% of widowers. So if you have kids, how do you make sure that the money is protected for those kids from the new wife or the new ex-wife? There are 2 very good ways to make sure that the money's protected and that come hell or high water, it makes it to the kids. The first way is for an irrevocable trust to be created immediately upon your death to hold a portion of the assets for the kids that will be completely protected from ex-spouses, future wives, creditors, debtors, and lawsuits. Second way is to require that any future wife sign a prenuptial agreement, and if they refuse to do so, then the irrevocable trust is then created.
