Florida and Alabama don't allow transfer-on-death deeds, but about thirty other states do. A TOD deed transfers property automatically when you die, skipping probate without the cost of a living trust.

Hello from Winter Park, Florida. I was thinking about Florida law today, you know, and Florida does not allow transfer on death deeds. And for that matter, nor does Alabama, where I usually practice. A transfer on death deed is an actual deed that you file at the courthouse, but it has no effect until the death of the person that made the conveyance. It does avoid probate. So if you absolutely don't want to spend the money on a living trust, try a transfer on death deed. They're available in probably 30 or so states across the country. Follow me. If anybody's in Winter Park, Florida, hit me up.
