Jerry Taylor explains why probate court benefits creditors over heirs. A will triggers probate, which is costly, public, and slow. A revocable living trust bypasses probate entirely, letting your estate settle faster and privately.

Does a will require your family to go to probate court? The answer to that is yes. If all you have is a will, your family must take it to court to make it legally enforceable. Here's my take on wills. A will is like requiring your family to file a lawsuit against themselves that they will pay for and that will only benefit your creditors. The only party that will come out of probate court ahead are your creditors. Do your family a favor and die with a trust. A revocable living trust will bypass probate court completely, and your estate will be distributed much quicker and much cheaper than they will ever get through probate court. And it will all take place in private instead of down at the courthouse. Go to my link for a newsletter and to work with me to get a trust.
