In this commentary, the speaker outlines a little‑known exemption in the 2010 Volcker Rule that permits banks to engage in certain commodity activities, and explains how the pending Clarity Act reclassifies crypto tokens as digital commodities. Because the Volcker Rule does not restrict spot commodity trading, banks could legally trade altcoins for profit. The speaker also references the so‑called Genius Act, which would let banks issue stablecoins backed by deposits on a fractional‑reserve basis. Together, these three regulatory pieces would allow banks to advance funds for token purchases, provide margin lending, act as market makers, lend against token collateral, and underwrite token offerings without additional approval. The speaker frames this as a potentially massive expansion of bank involvement in Bitcoin, Ethereum, Solana, XRP, DeFi, layer‑1/2 and meme tokens, warning that the combined effect could “swallow the entire altcoin market,” while also suggesting that savvy investors could profit from the banks’ new activities.

So there's a hidden exemption in banking law that legally allows banks to invest in the altcoin market, and it dates back to 2010, so nobody understands it. It was supposed to stop banks from gambling with your money. 16 years later, the exemption is about to swallow the entire altcoin market. See, after the 2008 crash, Congress banned banks from what they call proprietary trading. No more gambling with your deposits, right? So you put money in a bank, They legally have access to your deposits, do what they want. But you can't invest in, for example, securities, derivatives, and commodity futures or options. This is called the Volcker Rule. Look it up, the Volcker Rule. But what's not banned is things like gold, silver, oil, right? All of those are exempt. And obviously these banks lobbied for that, right? JP Morgan, Goldman Sachs, they're running a massive commodity desk right now as we speak, and they wanted to keep all of this excess income, of course. Now this is where it gets wild, because right now there's something called the Clarity Act, which is supposed to regulate all of altcoins, moving through the Senate, and it classifies crypto tokens as digital commodities, not securities. Commodities. And I know you see where I'm going now with it, right? Because the Volcker Rule doesn't touch spot commodities. The Clarity Act says tokens are commodities, therefore banks trading altcoins for profit is not prohibited by the Volcker Rule created in 2010. So these banks can't buy Apple stock, but they can, on their own book, trade your favorite altcoin for profit legally. Now combine that with the fact that the Genius Act allows them to create stablecoins from your bank deposits as well and use it for fractional reserve banking. They don't need it backed 1-to-1 according to headlines. They can legally use fractional reserve banking If it's classified as a deposit stablecoin, right? Combined all of this together, it gets a little bit out of control, doesn't it? And it's not just trading. The Clarity Act authorizes 14 activities for banks. They can advance funds to customers to buy tokens. That's 1920 margin lending with no cap. And you know what happened in the 1920s with the big crash. They can literally do market making. They can lend against token collateral. They can underwrite new token offerings all at once. No additional approval required. It sounds bad, but it's actually good news because we have Bitcoin, ETH, Solana, and XRP. They're already legislatively locked in as network tokens the moment that this passes, because it will pass probably within the next year, the Clarity Act specifically. And just to add kind of the cherry on top, layer 1s and layer 2s, DeFi tokens, and even meme coins explicitly qualify under this bill because they're considered commodities. Bakes didn't get lucky, man. They carved this out With the 2010 exemption, the Clarity Act is now gonna basically allow them to cash in. This is all in the Senate. If you pivot yourself right, okay, you can make a lot of money with the banks so you can keep fighting everybody. You can make money off of this.
