In this presentation, a former death‑penalty attorney explains the function and value of federal sentencing mitigation specialists. Drawing on his experience in South Carolina, he describes how mitigation specialists conduct deep background investigations—interviewing acquaintances, gathering records, and uncovering factors such as learning disabilities, childhood abuse, or tribal support networks—that can dramatically reshape a defendant’s sentencing narrative. He shares two concrete case studies: one where a client’s profound learning disability and abusive upbringing led to a sentence essentially limited to pre‑trial time, and another where a Native American tribal support system was presented to the court, influencing a more favorable sentence. The speaker notes that while his examples involved indigent defendants, mitigation services are also available to retained clients, especially given that roughly 98 % of federal cases end in guilty pleas, making sentencing strategy crucial. He encourages attorneys to consider funding or appointing a mitigation specialist and provides a contact number (803‑445‑1333) for further inquiries.

I'd like to spend a little time today talking about federal sentencing and the use of mitigation specialists for your case. So, my background, as many of you may know, was in death penalty work. And so, it was a part of every single death penalty case I was ever involved in that we had somebody on staff who was like a mitigation specialist. And that was somebody who would go out, who would talk to a whole bunch of people, who would collect records, and who would just really find out everything there was to know about the particular defendant going back, you know, a couple of generations even. And it was all a way of just kind of understanding, you know, what brought this person to this particular place and time. You know, because of sentencing mitigation specialists, I mean, that is how so many guys who have been capital defendants have been able to get life sentences. It's because of just the incredible amount of work and the important work that sentencing mitigation specialists do. I practice in the District of South Carolina. A few years ago, I decided to see whether or not I could get funding for an appointed case for a mitigation specialist. They provided it. They gave me funding and I hired somebody who I knew very well from death penalty days. And we started working on a couple of different cases, you know, non-death penalty cases. But she did the same kind of work for these clients that she had for guys on death row and really just found out some amazing things. And she was able to create these reports that we then filed along with our sentencing memorandum. And I will tell you that very much her participation in these cases moved the needle on those cases. I mean, I can tell you about one client in particular who was really very slow, but we didn't quite know what was wrong with him. So because of her ability to get these records and her drilling down and finding out as much as she could, an entirely different story of this person's life emerged. I mean, we found out about his repeating various grades, his profound learning disability, his being raised by a prostitute, and the sexual abuse that he experienced himself. And so what had started off as kind of a picture painted by the government of somebody who was part of this large drug conspiracy, who had kind of like a leadership role, we were able to show that that just was not the case. That this guy was in no way a leader. And in fact, he ended up getting a sentence that, you know, pretty much just the time that he was in pretrial incarceration, I mean, he pretty much kind of got out almost immediately. And the judge made a finding on the record that the reason why he was offering or why he was imposing that particular sentence was because of the information that was contained in that report. In another case, we had a client who was a member of one of our local Native American you know, tribes here in South Carolina. And that tribe offers a lot of assistance to people who are members of the tribe in, you know, getting work, getting trained for various things. And it was this whole kind of like support network that the judge didn't know about, that none of us knew about, until our mitigation specialist started doing the research. And so that was information that was given to the court at the time of sentencing. And again, I mean, this judge made a finding that this was incredibly important information. She was happy to have it, um, and it factored into the sentence that this particular client received. So, I mean, there are a lot of different things that, you know, a mitigation specialist can do on behalf of a client, and it's going to make a difference in how your client is sentenced. Now, I mean, I was lucky, like I said, because these clients that I'm talking about here, you know, were indigent defendants. But this is something that, you know, is available for people who are indigent or also retained. It makes a lot of sense to get somebody on the team who is directly involved with sentencing issues. You know, this day and age, roughly 98% of all cases in the federal system are going to be resolved by way of guilty pleas. And if that's the case, then sentencing needs to be front and center on everyone's mind. And just know that there is this additional kind of, you know, arrow in your arsenal that you can use to help your client or to help yourself. And I just wanted to share some of my experiences with this particular person and, you know, this particular way of addressing sentencing. So if you have any questions about this, please feel free to give us a call. Um, our telephone number at the office is 803-445-1333. Thanks.
