The Crime of Window Tint???? I say Legal Fockery!

In this episode of the Legal Fockery Show, host Gianna Miceli recounts her personal evolution from a 2006 traffic‑ticket victory to becoming a self‑trained paralegal who runs Legal Fockery University. She defines “legal fuckery” as the government’s use of language, contracts, and propaganda to claim authority over citizens, and she frames her work as exposing and defeating that authority. The core of the show is a detailed case study of a Texas driver who received a window‑tint citation on September 26, 2024. Gianna walks through the driver’s filing timeline—motion to dismiss (Oct 28 2024), formal objection (Nov 26 2024), the court’s failure to rule, a surprise plea hearing scheduled for Dec 2 2025, and a warrant issued on Dec 29 2025 despite inadequate notice. She argues that the court’s actions constitute a deprivation of 14th‑Amendment due‑process rights and a violation of 18 U.S.C. §242, labeling the conduct a federal crime. Throughout, she emphasizes the contractual nature of driver’s licenses, sovereign‑citizen concepts, and the importance of building an administrative record to support federal complaints. The episode also promotes her traffic‑ticket class, Legal Fockery University, and a free‑trial membership site, urging viewers to join and submit their own cases.

Good evening, I'm Gianna Miceli and this is the Legal Fockery Show. If you would have ever told me what, 20-something years ago when I stood up to my first traffic ticket, that I would ever be talking about it on the internet, I would have thought that was crazy. That was 2006 when I got pulled over by a police officer in Bear Mountain. I'm not gonna go into the whole story, but that was the first time my rights were violated. I was like, you're violating my rights, cannot violate my rights. I got psycho. I didn't know that I had my rights violated, but I met a paralegal the next day and he told me about it. He helped me with the paperwork and I went to a jury trial and one minute before they were going to pick 12 jurors and waste people's time with this traffic ticket nonsense. The prosecutor pulled out and I won. And I am still high from that victory. It was so much fun. If you have not heard, I've been talking lately in the last 6 months. I have attended paralegal school since the horrible departure. Well, I don't say the horrible departure since the departure of my former business partner, which you may have seen in my videos. I just said to myself, I can't depend on anyone else to do paperwork. And it was one of the most brilliant decisions of my life because now I am so dangerous. They don't even know how dangerous I am to have my common law education and combine it with statutory research. They don't even know. And so that's why I wanted to do this. Uh, it's gonna be a quick show tonight. Usually I do them on Thursdays with Patty, but this is just a, a quick show about a traffic ticket I wanna share with you that I am handling in my, as my new paralegal, uh, with my paralegal hat on. And it's very interesting because there's just like literally not an encounter with the government or the police or judges or prosecutors in which they're not violating your rights. And that's why I scream about this every day, all the time. I mean, it's wonderful that this is a great business for me, but I would do it for free. I love it so much. I will never, ever do anything else. So let me tell you what I'm going to talk about tonight. You might have seen I did post this blog. Couple days ago, but I don't think it got a lot of action, so I wanted to talk about it. Now, every Tuesday is when I post articles on X and LinkedIn, and they're always going to be true stories about people I'm helping through legal fuckery. And if you don't know what legal fuckery is, everybody knows what I want to say, but I have to be Google friendly. And legal fuckery is just the tricks and the language and the social conditioning and the propaganda that they, the world uses, the government uses to make you believe that they have authority over you. Now, before we get started, I wanna say one thing to you. I want you to practice this with me. Okay? Hopefully you can hear me. I don't have anyone helping me tonight. I'll find out when it's done. I'm not gonna stop the show and look. I want you to start practicing this sentence. Who are you to rule over me? Why do you ever think that your fellow man and woman and mankind has power over you. We give the government privileges to monitor bad people who break the so-called law, which means they harm someone else. There has to be a victim to have a law broken. Otherwise, it's just nonsense. So let's talk about the crime of window tint. This is a true story, one of my members. Now, let me back up for a second. I have a 100% success rate getting traffic tickets dismissed on paper without going to court. I only went to court that first time, took my day in court. Well, the trial, it was over within a minute. I don't go to court, I don't pay, I don't plea. I handle this on paper, and it always is questioning their jurisdiction, which they have to prove. Now there's people like, oh, you're a sovereign citizen. Well, I'm not. I mean, I am and I'm not. That's like a term the FBI made up to like dissuade people from exercising their rights, but we are We are sovereign. Our states are sovereign from the government, especially the federal government. And there's people that are trying to do what I do, but just haven't reached this level of understanding where the jurisdiction and the contract is and how to express themselves. So you're gonna see those people on court and, and you laugh at them and whatever, but you can laugh all day at me. I have a 100% success rate. I'm up to 15 tickets now. There's still 5 in the hopper right now from a year ago. which have been a little more serious. Not really, I just let myself get arrested. And so that's a bit different to handle than just traffic tickets. But I have discovered unbelievable legal fuckery in the situation now that I'm handling it myself as a paralegal and I'm not waiting on other people to do things for me. And that's what I say to you guys. Everybody's talking about the IRS today. Abolish the IRS. You're waiting for politicians to do something that you could do yourself. Go read my timeline. I have a great blog, an article coming out, I think tonight. I think it's at like 9:00 tonight that explains some incredible IRS standing. I've been screaming about this all year. So if you filed and you miss me, you should just take my class now and start getting out of the IRS and being prepared for next year. I know you're scared right now, but my class will remove the fear. So let's get back to this traffic ticket, the crime of window tint. One of my members came to me with a window tint ticket. I mean, I just laughed saying it. Oh, your window tint. Who are you to decide the tint of my windows? And it turned into a warrant. It was over a year old and I did not see a traffic citation case. I saw a crime. A warrant is out for his arrest because of a ticket for tint. Okay, let me tell you the story. I'm going to show you exactly what was done to this man step by step, because this is what happens when you don't know legal fuckery. Like, you could go look me up. People have looked me up online and looked at my tickets. Oh, she's full of shit. She's a sovereign citizen. Just because what it says on their website does not make it the truth, does not make it legal or lawful or the truth. Now let's understand who we are talking about. I am a person that is unlicensed and I have an unregistered car. It will never, ever step into a DMV for the rest of my life. I am the Rosa Parks of this DMV situation. There's other people trying to— we should put all our superpowers together. But when you get a driver's license, you waive all your rights. It's a contract where you don't know you're waiving your rights. You agree to become the legal entity that is the person of— that is what you agree to in the motor vehicle code. I don't drive a motor vehicle, I drive an automobile. You can laugh all you want, I have a 100% success us, right? Kiss my grits. Okay, now this is not a person who's driving in the private, who's sovereign, or in a no-license situation. This is a regular guy with a license, with the registration, with his insurance paid up. Just a normal guy who got pulled over for his window tint on September 26, 2024. Please take note of the date: September 26, 2024. Okay, and what the state of Texas did to him after that is what belongs in a DOJ criminal referral, not a plea and here's exactly what happened. So as per my guidance in my traffic ticket class, he filed a motion to dismiss on October 28th. Solid, and it's on the record. And then he filed a formal objection and demand for immediate dismissal on November 26th, about a month later, with a proposed order of dismissal attached, addressed directly to the court. If the court doesn't answer, I'm going for the kill shot. I'm going for the motion to dismiss, but now that I'm a paralegal, I got an even better plan. Okay. I'll get to that in the end. The court acknowledged his papers, his documents. When I say papers, his documents, because they put them on their docket. So they received them and then they ignored them completely. Okay. No ruling, no response, nothing. Now we will call them a notice. They have a title called a notice. And a demand, but they call them motions. Now, the difference is I have rights and I am notifying you that you're violating my rights and you should handle this, blah, blah, blah. They call it a motion because they believe we're asking the court motion this way or a motion that way. No, they're not motions, but this is some of the legal fuckery we have to rise above. So instead, on, instead of responding, On December 1st, 2025, 13, 14 months later after the original citation, the court opened a brand new complaint. December 1st, December 2nd, they scheduled a plea hearing. Now, let me ask you, if you get— if they make a court hearing on December 1st and they don't tell you, are you going to show up for December 2nd? Of course not. And that's what they want. They hope that you're stupid. So when he did not appear at the hearing he was never properly notified about, they issued a warrant on December 29th, 2025, which is kind of weird because in their world, if you didn't come to the December 2nd hearing, one would think they would issue the warrant, the so-called warrant, on that date. So it's weird that they waited, you know, a couple weeks. So they saw his filings, they logged them, and they proceeded anyway. So that's not a clerical error, and that is not an overwhelmed court system. This is a deliberate and willful and documented deprivation of due process by state actors under the color of law. Laugh all you want. I have a 100% success rate. Okay. And I have a name for that. I have several names actually, and you can find this in 18 USC 242, deprivation of rights under color of law. Those codes pertain to the government. They don't pertain to you. I can't deprive someone of their rights under the color of law. I'm not in the government. Now, the moment the court bypassed two pending dispositive motions and proposed an order of dismissal to take adverse action, they committed a federal crime, not a rule violation. It's a federal crime. It's a violation of 14th Amendment due process. Please, someone tag Harmeet Dhillon to watch my video. The right to be heard on a pending motion is not a courtesy. It's a constitutional guarantee. This is simple traffic court. Imagine what goes on in bigger courts. A court that acknowledges your findings and then acts as if they do not exist. Has denied you that right in writing and on the record. They always, they always have to give you remedy, but they're not going to tell you about it. They don't owe it to you to exercise your rights, but they also can't violate them if you know what you're doing. Now, this is abusive process. The December 2025 refiling did not happen by accident. It happened because the original track the one where his motions were sitting unanswered from October 2024 until December of 2025. He thought his documents worked, which they did in a way. He thought they worked because he did not hear from them and he went on with his life. Okay. Now they created a new lane and they tried to run him through it before he could respond. Less than 24 hours notice. Now, what this also is for the judge involved is a failure of ministerial duty. The judges have a canon they have to abide by. Judges do not get to choose whether to rule on properly submitted motions. That is not a duty. I mean, that is a duty, not a discretionary act. And sitting on two dispositive— I like to say it like that because I'm a paralegal now— sitting on two dispositive findings, and a proposed order from October 24th through December of 2025 is a failure of the duty. And it's documented on their own docket for all the world to see. This is all public. And this is shaming you. You know, people got my, my very horrible, um, um, mugshot before I could get it off. Florida is very amenable to getting your mugshot offline. And, you know, it's taken at 4 o'clock in the morning after I sat in a jail for since 9 PM. I don't really feel like I wanted my picture taken. So what does that make the warrant? That makes the warrant void. A warrant that flows from a void proceeding is itself void. That's referenced in Perlata v. Heights Medical Center in 1988. And due process requires notice reasonably calculated to reach you before a warrant can be issued for nonappearance. That's also covered in Mullane v. Central Hanover Bank. Regular mail with no proof of delivery does not meet that standard and never has. Now, it doesn't mean it has to be certified mail. There's some ambiguity about that. But if you're in court and you have to make a point, you better stamp that certified mail. Now, I'm going to be straight with you because I always am. You know that listing crimes is one thing like I just listed, but proving them in a filing are two different things. We're going to take this on in my new paralegal stature, which I'm dying to do. I'm dying to help this member with a federal case and take this traffic court judge to task. And so this is exactly why I built Legal Fauquier University. I opened it on— was like November 22nd of '22. I went into this research as a response from the COVID the COVID as I like to call it, the fake pandemic. Public because it was just mind-blowing to me that the whole world thought a mandate was a law and a rule and that corporations could rule over you and tell you to mask and vax. They can't. It's just a suggestion because those are medical devices, and unless they're a doctor and my doctor, they can't tell me what to do. And so the system counts on you not knowing that this gap exists. Now, when I tell you that my first traffic court victory was in— it was 20 2004, 2006, 2006, I believe. Yeah, 20 years now. 2006. Man, did they get the right girl. They got the right girl. So it counts on you walking into that courtroom scared, which never happened to me because my father was a cop. And when I was like 21, 22 and I got tickets, he would tell me what to do. But tickets were very different then. I believe they were more criminal misdemeanors, whereas now they're administrative. And that requires a contract to do business with you. So stop contracting into these tickets, which is why I'm never going to the driver's license bureau again. So it counts on you being scared. I just want to pay the fine because I want to get points on my insurance, and then your rates are going to go up. And you know, you're going to go home thinking you lost just because the judge said so, when you did not lose. You were intentionally robbed. You were misled. Which brings me up to a funny story. When I lived in Vegas, I lived a block from the traffic court place. And when you have to go through there, they check your purse and your pockets, you know, to see if you bring any weapons. And they give you that little bin and they're these very fat, lazy marshal people, you know? And so when you go through the conveyor belt and get wanded, and I would take my phone and my belongings out of the bin, and then I would just leave the bin there. And then I would start to walk away and they would call me back cuz they're fat asses just sitting around like this. With their big fat bellies, mostly men, and they're like, oh, oh, take your bin and put it over there. And I would say, excuse me, but I don't work here. And I would say it really bitchy and cunty. And you should have seen the looks on their face, because who are you to rule over me? You work here, civil servants. Okay, now this member I just talked about, he had real filings and real docket entries. If this was some sovereign citizen nonsense, do you think they'd put it on the docket? They would just send it back, but they don't. They're on the dockets. It's real case law. And he built a record. He began building an administrative record. And this is what I teach in my traffic ticket class. And because he built that record, what happened to him is not just an injustice, but it's documented, citable, arguable misconduct. That belongs in a federal complaint. And this is what the Legal Fockery University teaches. You know, sometimes I think the name of it is so crazy, but I spoke at an event, what, yesterday, 2 days ago, I think, in front of a room full of affluent people. There was attorneys in the room, and I decided I'm just going to say what I have to say. And I got a very good reaction even from the attorneys. So you have to be outrageous to be on the internet, and this stuff is just Exactly what it is. It's legal fuckery. And this is Legal Fuckery University. There's no outrage, there's no theory, and there's not arguments that lead nowhere. I have a 100% success rate. If you just met me tonight, I exited the IRS in 1999. I have never heard from them since, and I never will because I'm not in the contract. Tell them all about me. People tag me all the time. I tell on you. Yeah, go ahead, tell on me. What we have is a methodical, documented, citation-backed fight that puts their conduct on record as the violation. And now that I am finishing up paralegal school, the game is on because I know how to file a federal suit and it's not really hard at all. I did one using Scott and I found out, um, someone's texting me. I found out, um, where his language lacked credibility. So I'm better than Scott. If you know Scott and you're watching this, what's so shocking is I used to think Scott was so smart and now I think I'm so smart. I am old and I have earned this wisdom. So I have stood, I have fought, and I have won 15 times over. And I guarantee you that the last 5 tickets I have to go from last year will not only get me victories, they will be quashed with a motion. And then I'll be filing against all the cast of characters, which is about 10 people, in federal court. And I guarantee you they will make me a deal. They will Monty Hall the the fuck out of me because they have 45 violations and counting. I'm still waiting on the transcripts from the hearings. So I built this university so you do not have to figure it out alone the hard way with a warrant hanging over your head. And let me tell you about the warrant that this member got. It was about yay big on a yellow postcard, and all it said was, there's a warrant out for your arrest. That does not mean it's a real warrant. Why are they allowed to lie and propagate? If a judge didn't sign it, it didn't happen and it doesn't exist. Now, in my case, the judge told the clerk to sign it, so she signed the warrant when she can't. She has no power. But someone might tell you, especially, oh, it's policy. Yeah, well, we have laws and we have procedures and they're codified and they're in the state constitutions. And super F you, okay? She can't put a warrant out for my arrest. And when I looked it up on the Florida warrant website, I just can't think of the name of it right now. I'm not there, I'm not there at all. So that is legal fuckery, you know. I want you to pay attention to this video because the next window tint citation could be yours. It could be something silly, and when it is, I want you to be ready. I want you to think, oh, who is that girl? Who's that girl talking about the tickets? That crazy broad. The Sovereign Citizen with the 15 tickets and the 100% success rate. I want you to be ready. I am going to be opening up a traffic ticket citation funnel very soon. When I work it out, I want you to bring me your situations and let's see if you too are a victim of legal fuckery. Now, what we're doing with this gentleman is there's going to be a motion to quash on the way. What did we do here? How much time did we do? Just 21 minutes. I like to do the show and stay in the algorithm and I will say goodbye. Let me put, let me put my little banner. How do you join this? I made it so easy. Look, you guys join gianna.com. That's two N's. It's so simple. So come see, there's a 3-day free trial and see if you like what you see. If you're one of these kinds of Americans that wants to exercise your rights and feel like You know, we want only lions, not sheep, and I've done all the work for you. All right, I'm gonna see you later. We'll be back next Thursday with Patty, our silver stacking expert, and that's it. See y'all.
