Nadex: Termination Of Accounts For Any Reason?

In this solo‑host video, the creator discusses recent trader anxiety surrounding a clause in the Nadex customer agreement that states Nadex may "terminate your account or block access for any reason allowable under applicable law." He explains that such broad language is a common legal safeguard for exchanges, allowing them to act against unforeseen events (e.g., hacks or security breaches). While acknowledging the clause’s unsettling wording, he reiterates his long‑standing support for Nadex as the premier CFTC‑regulated binary‑options exchange, contrasting it with other platforms like Markets World (Marcus World). He critiques the higher capital requirements and contract size on Nadex, noting that many U.S. traders have limited savings, making the platform less accessible for beginners. He warns against conspiracy theories that claim Nadex trades against its users, labeling them speculative and endless. The video mentions a petition (deadline around March 27) aimed at the CFTC to pressure Nadex to amend the termination language, though the host admits he is not a lawyer and cannot confirm legal implications. Ultimately, he advises traders to diversify across multiple platforms—primarily Nadex and Marcus World—to mitigate the risk of being locked into a single exchange that could terminate an account arbitrarily. He provides an affiliate link for Marcus World and invites comments from the community.

Hey guys, welcome back to the channel. And today I want to talk a little bit about something that's going around about the Nadex and a situation where there is a petition to address a section of the Nadex customer agreement policy about, you know, various grounds for terminations of accounts. And, you know, one part of NADEX has, you know, been of very high concern. If you look here on the right-hand side of your screen, second paragraph, this is under the termination section. It reads, NADEX reserves the right to terminate your account or block access to Nadex for any reason allowable under applicable law. And, um, you know, what's become of great concern to many traders on the Nadex is the specific words 'for any reason.' So, you know, there's been some various legal interpretations of, you know, what exactly that means. Sometimes you know, to protect— for businesses to protect themselves, they'll write the law in this manner, you know, in a way to be able to encompass a broad range of things so that, you know, they don't find themselves, you know, at a disadvantaged, you know, position. And what I want to say about the NADEX is, you know, as I've said it in many of the videos I've done, is that Nadex for me is the best binary options trader out there, CFTC regulated. And my opinion of that has not changed. So I'm a big supporter of the Nadex. Now I have promoted Markets World more so than the Nadex, and a lot of that has to do with capital. you know, who's trading, who's coming in. And, um, for me, Nadex is a much more complicated trading situation, uh, than what you'll get at like Markets World or some of the other binary options brokers because Nadex is an exchange. And so Nadex is a third party. They don't have anything to do with the trades, being involved with the trades or anything like that. They're just getting a commission, uh, you know, uh, for the, you know, the trades being made by members of the Nadex like myself and you all. So, you know, Nadex, you know, is not even involved in the actual trading like some other brokers are. You know, Nadex makes its money either way. It makes it on whether you win or whether you lose. And their business doesn't or shouldn't, you know, depend on, you know, what happens, you know, at the end of a trade and what have you. But, you know, sometimes out of fear, people start to come up with, you know, all types of conspiracy theories. And that's always been my problem with conspiracy theories, whereas conspiracy theories may initially prevent and, you know, a way of thinking that can be helpful to one being cautious of certain situations. Conspiracy theories don't seemingly have an end to them. So a conspiracy theory can just go on and on and on, and before you know it, you know, you got all kind of things going around. That's like sort of what's starting to happen with the Nadex system, you know, that people are thinking, well, maybe Nadex after all are on the other, you know, on the other ends of these trades and things like that. I personally don't think that's what it is. I think Nadex is using a, you know, this, this, this, this legal language here to protect itself in the event of unforeseen occurrences. You know, despite that though, people are pushing to have a petition signed up and made, sent in, I believe before the date is the 27th, before you know, something going on about the CFTC and them filing petitions in order to, you know, attempt to, you know, stop this type of language. But, you know, you know, I'm not certain if this is— I'm not a lawyer, so I can't, you know, really, you know, speak on, on this. But I can say this, that I would, you know, it would seem plausible to me that, you know, many such systems would want a very broad, uh, you know, angle to be able to protect themselves from things that they may can't see happening. You know, for instance, you know, maybe if some kind of way the Nadex was hacked, uh, and they were suspecting that certain account members were responsible for that, maybe they want to just terminate those accounts, although they had no solid proof. And I'm just, you know, make, you know, I'm just trying to come up with some ideas of why the language reads this way, you know. But of course, you know, you know, as I'm not a member of NADEX, I can't really speak on, you know, why NADEX is wording this like this. They would have to, you know, make, you know, you know, make statements about that. And, you know, sometimes situations like this you won't get any information, you know, as again, they don't want to, you know, find themselves liable by saying things that are, you know, are going to, uh, you know, contradict or, you know, go basically go against, uh, you know, uh, you know, the method in which they're trying to protect themselves. So, you know, all that kind of goes into it. And the only thing I can say about it, guys, is that I'm, I'm still a big believer in Nadex. I still support the Nadex. I still think it's the best system next to Marcus World. You know, I think Nadex would be number 1, Marcus World would be number 2. So, you know, a lot of people ask, why do you always promote Marcus World? Well, you have to understand, my only problem with Nadex is I still look at Nadex as a, you know, an investment situation where I a small pool of traders, a small group of individuals are going to be, you know, able to really use it. And I, in a lot of my past videos, I guess reasons for that, I give reasons like the average American, you know, only has about $2,000 in savings in the bank or under. And so I just don't think that it's going to be, you know, realistic for if you want a larger pool of investors to come into markets. I just don't think that's going to be You know, realistic to think that people are going to be picking up Nadex contracts, you know, at $50 a pop. And I know a lot of people say, well, you can get out of Nadex contracts very easily and things like that. But you know, if you're not watching those contracts, your $50 investment can easily go well below. And before you know it, you've, you know, you've pretty much lost that entire $50. By the time you pick up, you know, 10 or 20 contracts, you're at over $1,000. And, um, you know, that's just how Nadex contracts are structured, you know. Whereas with Marcus World, you can jump in, you can jump out, you can dabble with a few bucks, you can dabble with, uh, several hundred bucks, you know. But you can, you know, you're not locked into certain volume of contracts and things like that. Uh, so that's, you know, that's why at least for the beginner levels, I've always, you know, promoted Marcus World. But I do want to say this, if the fears of Nadex that, you know, that's kind of going around right now, if they're warranted in some kind of way. You know, always the best protection I think for a trader has been to diversify how they trade and where they trade. And, you know, again, for me, that would be Nadex and Marcus World. So Marcus World would be my diversification. I have a link in my description. Um, you know, if you, you know, if you're like diehard Nadex, like I know a lot of traders are, and I can understand why they are, uh, you know, maybe this may be a sign to diversify your trading, especially if this is your bread and butter, uh, job and earnings, and you do this for a living, and this is your, you know, your, your principal, uh, way of earning a living. And that's an issue because then you are basically, you know, trapped into Nadex, and Nadex is going to be the only way you can survive because Nadex is the only thing you trade. So in a situation like that, I would probably advise that you look into trading other platforms, not giving up on Nadex, but, you know, because again, the Nadex to me is the best. I want to be clear in saying that, that I support Nadex, but this is the information that's around online right now. And, uh, you know, obviously if a person's put their, uh, you know, their, their, you know, their, um, their occupation and their, um, you know, their life into trading on a situation like the Nadex, and Nadex has verbiage and language like we can just terminate your, your account at our sole discretion, uh, for any reason, then that's, you know, that's basically not making you feel secure. It's not making people who want to try, try trading Nadex, it's probably not going to make them feel like it's a reliable platform for them to do as a living. So those are just some things to think about, guys. And, uh, you know, talking about this situation, what's going on with the natives, I'm not concerned about the situation so much because I'm going to tell you like this, my perspective of it is pretty much every, um, system is going to be, uh, writing in a language similar to this, because as soon as something fishy happens, uh, they aren't going to want to be dancing around the legal system to get rid of someone who's compromised their system or security or things like that. So I'm— my guess is that's pretty much what's going on with Nadex. I don't think, uh, it's necessarily Nadex is, uh, uh, trading against, uh, you know, other traders, which is, you know, which is one of the conspiracy theories going around right now, you know, where you kind of got this Goldman Sachs type Congress situation. But in saying that, guys, you know, nobody— you know, I mean, I can't be 100% sure, you know, that this— that couldn't happen. And, you know, I don't think anybody could, but I don't think there's been sufficient evidence at this point to where that's the case. Although I have started to see some stories where people are trying to say certain things about the Nadex system, about you know, about deposits that, you know, they were— they were credited for money they weren't credited for, trades or what have you. And, you know, again, guys, this is a, you know, system created by man. And, you know, it may not be that every, you know, negative thing that happens or unpredictable thing that happens on the system is the design and, uh, machinization or machination of the creator or some way to defraud people. It could just be a common human error, glitch, or problem, you know, with the system, and that could be pretty much the end of the story. So we also have to look into that. But, uh, I guess the purpose of this video, guys, coming from me, is that, you know, maybe it's time to diversify. If this is true, whether it's true or not, Maybe this means this is time to, if you've only traded one system, you know, be open to trading maybe another one, you know, maybe trading a system like the Marcus Rule. I invite you with my link. I do put some, you know, information about Marcus Rule on my videos. If you haven't traded, if you don't, you know, if you don't trust it, if you, you know, think it's a scam or something like that, or, you know, or it's just not a good system, You know, and, you know, but basically, you know, you could try to find out and see. It's worked pretty well for me. I like how Marcus Rule is. I like how I can come in low, I can come in high, and get out easy. And, you know, this is not a concern of mine when I'm trading, you know. So anyway, guys, you know, if you have any comments about what's going on with Nadex, if you're a Nadex trader, give me my opinion. Let me know how you, you know, feel about it, you know. And until next time, guys, happy trading.
