In this 2026 webinar, Ben Walker and Glen Hynd (Gather) together with SECA Executive Director David Allen unpack NEC4 Clause 13, the contract’s communication provisions. They stress that Clause 13 is not merely administrative but underpins the whole contract, and mis‑communication is a common source of disputes. The session walks through the eight sub‑clauses, covering the required form and language of communications, the need to use defined/identified terms, the effect of specifying a communication system in the scope, and the practicalities of cloud‑based contract management tools. They warn against informal channels such as verbal instructions, WhatsApp or Snapchat, and explain how to ensure a communication has effect (address, system, timing). Timing rules – period for reply, extensions, and the importance of agreeing extensions – are clarified. Acceptance, withholding acceptance, and the correct use of contract verbs (accept, notify, instruct, submit, propose, inform) are highlighted, with advice to quote clause numbers and avoid ambiguous language. The presenters demonstrate how modern dashboards and pro‑formas automate compliance, track early warnings, compensation events and certificates, and support governance, culture and discipline (the “Bennett Triangle”). Throughout, they stress collaborative behaviour, training, and the need for clear, recorded, contract‑compliant communication to achieve “right‑first‑time” outcomes.
