NEC4 Communication Done Properly

In this NEC4 webinar (Episode 11) Glen Hythe, Ben Walker and David Allen discuss Clause 13 of the NEC4 contract, which governs all contract communications. They explain why Clause 13 is more than an administrative clause, outlining the eight sub‑clauses that dictate the form, timing, and effect of communications. The panel stresses the need to use the contract’s defined and identified terms, the exact verbs (accept, notify, instruct, etc.), and to follow the prescribed written‑in‑readable‑copyable‑recordable format. They compare verbal, email, WhatsApp and Snapchat communications, concluding that only a system specified in the Scope (usually a cloud‑based contract management system) can reliably meet the requirements. The speakers walk through practical issues such as: how to set up and change the communication system in the Scope, how to handle extensions of reply periods, the obligations around acceptance and withholding acceptance, the role of Z‑clauses, and the importance of keeping notifications separate from other documents. They also cover the use of registers, pro‑formas, early‑warning and compensation‑event registers, and the cultural benefits of a well‑governed system (knowledge sharing, discipline, reduced adversarial tone). Throughout they give concrete tips – quote clause numbers, use the contract’s language, ensure the right parties are addressed, delegate authority correctly, and embed the system from day 1. The webinar ends with a reminder that good communication under Clause 13 underpins project success, reduces disputes, and should be reinforced with training and collaborative behaviour.
