The new law approved in Spain in 2023 on the protection of animal rights and welfare 7,2023rds of March 28 brings with it some important changes that affect dog guardians and carers. Let's get to it. Expert 1. Is dog insurance mandatory under the new animal welfare law? The new animal welfare law includes the obligation to have insurance for any breed of dog. If we take into account that Article 30 of this law establishes that it is mandatory for all carers to have insurance for their dog, although it cannot yet be required in order to require dog insurance, its regulatory development must first be completed. Thus, all the measures are expected to come into effect over the next two years. 2. But what type of insurance is mandatory for dogs? The new law only makes civil liability insurance mandatory for dogs. This is insurance for dogs that covers and protects the owner for any damage that their pet may cause to third parties or their property. For example, if our dog accidentally knocks someone down in the street and causes them injury, if our dog sneaks into a property and causes damage, civil liability insurance would also cover the damage caused. Will insurance be mandatory for all dogs? Yes, civil liability insurance will be mandatory for all dogs. Before the new law came into effect, civil liability insurance for dogs was only mandatory for potentially dangerous dog breeds, also known as ppp. These breeds include, for example, the Akihabara or the Rottweiler. However, when the regulations for the new law are developed, all dogs will have to have this mandatory insurance regardless of the breed of dog they are and their characteristics. The civil liability insurance must cover the expenses arising from possible damages and injuries caused by our dog to third parties. An exact figure has not yet been determined within the new law, but to date this insurance for potentially dangerous dogs covers a minimum of €120,000 in damages. Basically, the civil liability insurance for dogs must cover enough to cover possible expenses arising from damages to third parties. 5. What happens if I do not take out the mandatory insurance for dogs. If we do not take out mandatory insurance for dogs, we would be breaking the law and would have to face a fine or fine of between €500 and €1,000.
