Day 7️⃣: How to LEGALLY Smash a Hot Cars Window

Max Randall explains how to legally break a car window to rescue a dog in the UK. Call 999 first, document everything, then invoke the lawful-excuse defence under Section 5 of the Criminal Damage Act 1971 if the dog is in distress and police are slow. After rescue, move the dog to shade and cool it down.

It's only 24 degrees outside, so someone leaves their dog in the car for just 10 minutes. Studies have shown by the time they come back, the inside of that car is 35 degrees Celsius. Do you smash that window? This is a 4-step legal procedure in the UK to take if you intend on smashing that window. Hi, I'm Max Randall, and welcome to day 7 of the summer series, collecting a nugget of value each day until you can confidently lead your dog through summer. And here's everything you need to know about legally smashing windows. I know, right? Before we get into that 4-step guide, I just want to say this table here, it can be found in the link in my bio, which has everything we need to know about smashing windows and temperatures. So everything in this and more will be on that table. So in the UK law, this is what we're legally allowed to do. Step number 1, phone 999 and just let them know what the hell is happening and tell them to come over. Very simple stuff. I'll explain why this is really important in step 3, but legally this is a non-negotiable. Step number 2 is just note the registration of the car, the time, and also get some witnesses. Get some lads, point and go, "You see this? Yeah." And what you also have to do if the dog is not in distress, go find that owner. We're gonna be learning in a few days how to read if a dog is in distress, so don't worry, you'll be able to confidently do this. Step number 3 though, if the dog is in distress and the police can't get there in time, It's time to smash a window. So here we're in the Criminal Damage Act territory. So basically, Section 5 of the Criminal Damage Act of 1971 gives you a lawful excuse defense. You have a lawful excuse to damage someone's property if you honestly believe that the owner would have consented to it if they knew the circumstances. It's a bit weird, I know, but that's basically the legal hook that the police and the RSPCA cite. But that's basically the bit that social media glosses over because this is not a right, it's a defense. So you have to be prepared to go through, you know, go down the legal route in court if they choose to have a go at you for it. So this is why you have to tell the police on the phone exactly what you intend to do and why, so it's logged before you do it. You photograph or film the dog's condition before you act. You get names and phone numbers of those lads. Witnesses, because this basically just helps you prepare to justify your actions if it ends up going to court. And then step number 4, of course, after rescue, you have to take the dog to the shade, help cool them down. And don't worry, we're also going to be learning about the proven most effective ways to cool a dog down. But the question really is, how can we tell if a dog is getting too hot? Well, I'll see you tomorrow morning for that one.
