Scott Levin argues that hiring a litigating attorney as a divorce mediator undermines the process. Mediators need to be genuinely neutral, and full-time peacekeepers can maintain that neutrality better than lawyers trained in adversarial work.

I get this one all the time. Hey Scott, my lawyer says they can mediate. Why don't we just hire them as our mediator? You know, neutrality is the key to mediation. You have to have someone that both parties trust and that they don't believe that they're on one side or the other. It's very difficult, even as a full-time mediator, to maintain that neutrality, and I believe that that neutrality comes from someone that's a full-time peacekeeper and not a litigator.
