Okay, so let's get into this third most common tutorial act. And this is episode number three. This is the final one. And the first thing that I want to start out doing with you all is this is the jurt. Okay, we're going to go over the jurt and let's look at the difference between what I presented to you so far as far as the acknowledgment and the oath. And I want to show you the differences between the acknowledgment, the jurat, the oath and affirmation. Okay? So in an acknowledgment, the signer does not have to sign the document in front of the notary. They have to acknowledge that the signature is theirs. They also do not have to say an Oath. And there is no wording on that certificate that states sworn or affirmed or any other similar language. On the jurat. However, the signer has to sign in front of the notary, and they are swearing that the information contained within the document is true. They're not just swearing that their name is true or that they just signed the document. They're saying that I am who I am and the information within the document is correct and true. A jurat does require an oath or affirmation, and the certificate wording will include the word sworn, affirmed, or similar language. Now, jurats do include an oath, right? And now I want to talk to you about the difference between an oath and an affirmation. An oath is basically saying, you know, I do swear to tell the truth and the whole truth, nothing but the truth, so help me God. That's an oath, okay? It's a solemn spoken pledge to a supreme being. An affirmation does not include the words so help me God. It's just a pledge on one's own honor. Just saying, I promise. It's a promise. I promise I'm gonna tell the truth. Do you swear to tell the truth and hold and the whole truth and nothing but the truth? You leave out the word God. So an oath requires a supreme being like God, and an affirmation does not. And regarding this information, I'm going to put it in a different way at the end because everybody learns differently. So we'll go back over it. The purpose of a juror rat is for the signer to swear or affirm that the contents of the document are true, depending on the jurisdiction. It's also known as an affidavit or verification on oath or affirmation. For a jurat, the signer must personally appear before you, the notary, and sign the documents in your presence. You must administer an oath or affirmation and have the signer speak aloud his or her promise that the statements are true and correct. The choice between an oath or affirmation should be made by the signer. So you actually ask them, do they want to do an oath where they swear before a supreme being like God, or do they just want to do an affirmation which is a promise? Now, the portion of this, this is from the nna, and the portion of this that states that the signer must speak this aloud, that is taking a formal or ceremonial oath. And we'll get into that later. In mortgage documents, we usually don't have them say this out loud, and that's called a written oath. But like I said, we'll get into that. Administering the oath or affirmation is a vital part of performing a jurat or verification because the signer is affirming that the contents of the document are true. And guess what? If they lie, it's perjury and they can be prosecuted if the contents are not true. California requires a signer to provide proof of identity for a jurat. And in all notorial acts you always get proof of identity, right? But make sure when you're going through this stuff, look at the requirements of your state, because every state is different. When is a jurat required? Juts are generally performed on affidavits as notary signing agents. There are a whole lot of affidavits within those loan documents. The juts are also required for various legal documents and depositions regarding court documents. How to complete your jurat Again, you require a personal appearance. They have to be in front of you. You review the document. You screen the signer and verify the facts by looking at their two forms of id, by reviewing the document, making sure that all pertinent information is contained within your certification portion. And then you record the notarization in your journal before you even do anything else, before you complete the doggone jurat, record the notification, the notarization in your journal. And then, and only then, do you complete the jurat. Now here are the notary's responsibilities. Again, you require a personal appearance. You, the notary, are the person who will administer the oath or affirmation. And again, your client is the one who says, I want to do an oath or I want to do an affirmation. There are two types of oaths or affirmations that you will perform. One is spoken verbal or oral. The other is written as I stated before, and let's go through that one. You speak out loud. The other is just written spoken oath or affirmation. Example do you swear to tell the whole truth? Do you swear to tell the truth, the whole truth, and nothing but the truth shall help you God? I Then they state their name, do solemnly swear or affirm that I will faithfully, impartially, and justly perform all duties of the office of whatever their office is to the best of my AB so help me God. And so the difference again between an oath or an affirmation is an oath will contain the words so help you God, or so help me God, and an affirmation will not contain those words. An oral ceremony of oath or affirmation. You raise your hand, they're standing and it's a verbal response. So this is a more formal way of performing an oath where they raise their hand, they're standing, it's verbal, it's ceremonial. And it is to impress upon the person that this is serious. This is a whole ceremony. And so they're taking it very seriously. Now, the written oath or affirmation, let me give you an example of that. And it's required by some states, recommended by others. These are examples. So as you can see, the state of Illinois, county of whatever county you write that in. On this 12th day of November, 2020, I, Latonya Johnson, do solemnly swear. That. Do solemnly swear makes that a what? That's an oath. That the statements contained in this affidavit are true to the best of my knowledge and belief. The affiant signs the document. You, the notary, witness, my hand and seal, Latonya Johnson, notary public of the state of Illinois Commission expires. You write the expiration of your commission, you sign it, you date it, and you place your stamp. Now, let's check this out. Okay, so sometimes you cannot tell where the certificate is. Right. Guess what? There it is. And I blew this section up so that you could see it even better. It says personally before me on this 12th day of November, 2020, the name of the person. So, Latonya Johnson. And I'm saying my name twice. But of course, you can't. You can't notarize your own documents. This is, for example, purposes only. Latonya Johnson, who deposes and says that the above statement is true and correct to the best of his or her knowledge and belief. Notary public, you sign it. You write in your name. I always do that because my signature will not let you know what my name is. And underneath that line, I'll probably put the expiration date of my seal and then I'll stamp in that blank space. Here's another one. Now, where do you think in the document. It's hard to see where this, this notarization occurs. Right where what your party is the sworn part. Guess what? It's right there. Date, sworn and affirmed. That's what makes this an oath or an affirmation. And here it is again. I just made it a little bigger. So notary sign and seal, notary signature dates the commission expiration date and official capacity of the official administering the oath. That would be you, a notary public, loan signing agent or notary public for the state of Texas is what you'd write there. And if there is no place for your seal. Then you'll have to use a loose certificate. And a loose certificate of an oath is what you'd use. So you would place on here C attached loose certificate and cross out with a single line these other lines that you're supposed to complete. And that's how you do that. Here's another example. On this day, 12th day of November 2013, before me personally appeared to me known, who being duly sworn, did depose and say, so what makes this an oath? Sworn did depose and say. That's what makes this an oath. That he or she resided in Arizona, that he or she is the member of the corporation described in this instrument as the. And they will tell you, you know, your client will tell you what goes in this section. So that he or she is the CEO, is the member, is an officer. Okay, now let's talk about completing your journal entry. Now, these journal entries, listen, this is very, very interesting because you look at the, at the requirements in your particular state. We're going to go over some generalizations here, okay? The first thing you do is add the day and time of the notarization. What type of notarization? You're doing an oath or an affirmation. The location that the notarization is taking place. Is it a spoken or written oath or affirmation? The name and address of the signer, the identification method. And please note that in the state of Texas, you cannot record a Social Security number. You cannot record the license number within your journal. It is prohibited. So be sure to look at the rules of your state because you can get in trouble. Any additional information that you want to put on there, this is just for general comments for yourself. You also supposed to record what your fee is. If you're doing this for an individual that has paid you individually and not through a service. And then you get the affirmance signature. Some states, like California, require a thumbprint and you get that. State of Texas does not require that. All right, so folks, that's it. Let me know if you need me.
