How do I back out of a contract? Great question. In the unfortunate case that you can't find a buyer or you don't have the money to perform on the agreement, then you are going to have to terminate the agreement to be in good faith. Now, with the agreements that I use, you don't have to do that because you're released of all liabilities, but I always recommend you send over a termination of agreement pretty much saying, hey, we are not interested in the property anymore, we are backing out of the agreement. You get that signed by the seller, you sign it, send it over to the title company, and now the purchase and sale agreement that you had signed in the first place to actually buy the property property and then assign it to a real estate investor is now voided. Depending if you were smart or not and put earnest money or you didn't, you are going to have to forfeit that earnest money depending on the clauses that you have on the agreement. For the most part, I never put earnest money on my property, so if I ever do have to back out of an agreement, I never lose any money. Now, this template I'm going to show you is only for my contracts, but you can take something similar and use it for yourself. Boom, boom, boom, boom.
